These terms form a contract between you ("you", "the customer") and Design Technology Ltd, trading as Transcom (Company No. 2828342, VAT GB 635 7737 09, registered at Concorde House, Brighton, BN2 1TS). By ordering or using any of our services you agree to these terms.
"Services" means any product we provide, including domain registration, web and email hosting, virtual private servers (VPS), domain dropcatching, security and forensic services, and related software. "Registry" means the body responsible for a domain extension, such as Nominet for .uk domains.
You are responsible for keeping your account details and login credentials secure, for the accuracy of the information you provide, and for all activity that takes place under your account. You must notify us promptly of any unauthorised use.
You must not use our services to send spam or unsolicited bulk email; to host or distribute malware, illegal content, or material that infringes the rights of others; to attempt to gain unauthorised access to any system; or in any way that disrupts our network or other customers. We may suspend or remove services that breach this clause.
Domain registrations are subject to the rules of the relevant registry, including Nominet's terms and conditions for .uk domains. Registration is not guaranteed until confirmed by the registry. You are responsible for renewing domains on time; expired domains may be suspended, deleted or released in accordance with registry policy. Dropcatching services are provided on a best-efforts basis and a successful catch cannot be guaranteed.
Charges are as shown at the time of order and, unless stated otherwise, exclude VAT, which is added at the prevailing rate. Recurring services renew automatically for the same period unless cancelled before the renewal date. Prices shown as "per month" are billed on a recurring basis. Non-payment may result in suspension or termination of the affected services.
Domain registrations, renewals and transfers are non-refundable once submitted to the registry, as these costs are incurred immediately. Other services may be eligible for a pro-rata or goodwill refund at our discretion; please contact us to discuss.
We work to keep our services available and resilient, but we do not guarantee uninterrupted service. We may carry out planned maintenance, giving reasonable notice where practical, and may take emergency action to protect our network. Free backups, where offered, are provided as a convenience and you remain responsible for keeping your own copies of important data.
You may cancel a service in line with its notice period. We may suspend or terminate services where you materially breach these terms, fail to pay, or where required by law or registry rules. On termination, your right to use the affected services ends and associated data may be deleted after a reasonable period.
Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, loss of profit, data or business, and our total liability for any claim is limited to the charges paid by you for the affected service in the preceding twelve months. We provide services to businesses and consumers; your statutory rights as a consumer are not affected.
We process personal data in accordance with our Privacy Policy, which forms part of these terms.
We may update these terms from time to time. The current version is always available on this page. Continued use of our services after a change means you accept the updated terms.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
